Legal terms for using the Eterniq platform, including consent for ML training with your health data

Welcome to Eterniq!

These Terms and Conditions ("Terms") govern your access and use of the Eterniq platform ("Platform"), including any content, features, and services offered. By accessing or using the Platform, you agree to be bound by these Terms, which comply with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

If you do not agree to these Terms, please do not access or use the Platform.

1. Use of the Platform

1.1 Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

1.2 License

Subject to your compliance with these Terms, Eterniq grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use.

1.3 Restrictions

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Interfere with or disrupt the Platform or its servers
  • Use automated means to access, scrape, or collect data from the Platform
  • Attempt to gain unauthorized access to the Platform or user accounts
  • Modify, reverse engineer, decompile, or create derivative works
  • Transmit viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Platform to provide services to third parties

2. Account Registration and Security

2.1 Account Creation

To access certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

2.2 Account Responsibility

You are responsible for all activities under your account. Notify us immediately at support@eterniq.life if you suspect unauthorized use.

3. Health Data and Machine Learning

3.1 Consent to Data Usage for ML Training

By accepting these Terms, you consent to Eterniq using your anonymized and aggregated health data to train and improve our machine learning models.

This includes data from:

  • Wearable devices (heart rate, sleep, activity levels, etc.)
  • Health calculators and assessments (BMI, PhenoAge, etc.)
  • Manually entered health metrics
  • Supplement tracking data
  • Platform usage patterns and interactions

We use this data to:

  • Develop and refine longevity prediction algorithms
  • Improve personalized health recommendations
  • Enhance platform features and user experience
  • Conduct research on health optimization and longevity

Important: Your data is anonymized and aggregated before being used for ML training. We do not use personally identifiable information (PII) in our training datasets. You can withdraw this consent at any time by contacting us at privacy@eterniq.life, though this may limit the personalization of your experience.

3.2 Data We Will Not Sell

We will never sell your personal information or health data to third parties for marketing, advertising, or commercial purposes.

Your health data is sacred. Our business model is based on providing value through subscriptions, not monetizing your data.

4. User Content and Responsibilities

4.1 User-Generated Content

You may submit content such as health data, feedback, feature requests, and support messages ("User Content"). You represent that you have the right to submit such content and that it does not violate any laws or third-party rights.

4.2 License Grant

By submitting User Content, you grant Eterniq a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display such content in connection with the Platform and our services. This includes using anonymized and aggregated data for research, development, and improving our ML models.

4.3 Prohibited Content

You may not submit content that:

  • Is false, misleading, or fraudulent
  • Violates intellectual property rights
  • Contains viruses or malicious code
  • Is defamatory, obscene, or offensive
  • Violates privacy or data protection laws

5. Intellectual Property

5.1 Platform Ownership

The Platform and all intellectual property rights, including copyrights, trademarks, patents, trade secrets, and proprietary algorithms, are owned by Eterniq or our licensors.

5.2 No Implied License

These Terms do not grant you any rights to use Eterniq trademarks, logos, or other brand features without our prior written consent.

6. Health Disclaimers

6.1 Not Medical Advice

The information provided on the Platform is for informational and educational purposes only and does not constitute medical advice.

The Platform is not intended to diagnose, treat, cure, or prevent any disease. Always consult with a qualified healthcare provider before making health decisions or starting any supplement, exercise, or lifestyle program.

6.2 No Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or completeness of information
  • Uninterrupted or error-free operation

6.3 Accuracy of Information

While we strive for accuracy, we do not guarantee that all information on the Platform is accurate, complete, or up-to-date. Health and longevity science is rapidly evolving, and recommendations may change based on new research.

6.4 Third-Party Integrations

The Platform may integrate with third-party services (e.g., wearable devices). We are not responsible for the accuracy, reliability, or security of data from third-party sources.

7. Data Protection and Privacy

7.1 Privacy Policy

Our Privacy Policy explains how we collect, use, and protect your personal and health data. By using the Platform, you consent to the data practices described in our Privacy Policy.

7.2 Your GDPR Rights

Under GDPR, you have rights including access, rectification, erasure, restriction, portability, and objection. See our Privacy Policy for details on exercising these rights.

8. Subscription and Payments

8.1 Subscription Plans

Certain features require a paid subscription. Subscription terms, pricing, and billing cycles are described at the time of purchase.

8.2 Billing and Renewals

Subscriptions automatically renew unless canceled before the renewal date. You will be charged the then-current subscription rate.

8.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

8.4 Changes to Pricing

We reserve the right to change subscription pricing with 30 days' notice. Continued use after price changes constitutes acceptance.

9. Limitation of Liability

9.1 Exclusion of Damages

To the maximum extent permitted by law, Eterniq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Health complications or medical issues
  • Emotional distress or personal injury

9.2 Cap on Liability

Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to Eterniq in the 12 months preceding the claim, or €100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Eterniq and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content

11. Termination

11.1 Termination by You

You may terminate your account at any time by contacting support or through account settings.

11.2 Termination by Eterniq

We may suspend or terminate your access to the Platform at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Any reason, with or without notice

11.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. We may delete your account and data in accordance with our Privacy Policy and data retention policies.

12. Dispute Resolution and Governing Law

12.1 Governing Law

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
